Claim for Exemption Process
An Exemption may be claimed if a private postsecondary institution has reviewed rule 5.100.002 NMAC or 5.100.003 NMAC as applicable and believes the institution qualifies for at least one exemption criterion from licensure requirements. Please refer to the claim for exemption application form below. The Department will notify the institution once a determination on the institution's exemption status has been made.
PUBLIC out-of-state institution do not qualify for this exemption as they are not subject these rules and related statutes.
When an institution applies for exemption status, the institution agrees to provide annual update reports informing the Department of all new course offerings or program changes; furthermore, the institution and its representatives agree to make no reference to the Department in advertising and/or printed materials.
NOTE: Not submitting the annual update report may be grounds for discontinuation of an institution’s exempt status.
Annual update reports will be due on July 15, 2011.
